Terms of Use

ACSC | CCYA team (hereinafter referred to as "the Company") will provide a system named “ACSC | CCYA” (hereinafter referred to as "the Application") designed to enhance the public transport experience and provide users with fun and engaging content such as movies, videos, music, and other forms of media.

Users may utilize the Application in accordance with these Terms of Use. Furthermore, by using the Application, users are considered to have agreed to these Terms.


1. Definitions
In this agreement, the following terms are defined as follows:
“Service”: Service provided by the Company using ACSC | CCYA application.
“User”: Anyone who agrees to this agreement and uses the services by using the Application.


2. Services
Constant internet access is necessary when start using the service. Users must use the service under the operating environment specified by application guideline. The download of plugin software, security software, etc., is the responsibility and expense of the user.
Users acknowledge that depending on the specifications of their operating environment, some or all of the functions from the Application may not be available, even if they use the service under the operating environment specified by application guideline. Additionally, the Company does not guarantee compatibility with any future software or other products that may be developed.


3. Use of the Service
. Users may utilize the service after they agreed to these Terms of Use.
. When a user uses the service and completes the procedure to agree to these Terms of Use, it establishes a usage contract between the user and the Company, subject to the provisions of these Terms.
. If a user is a minor, they must obtain the consent of their legal guardian or other statutory representative before using the service.
. Users shall use the service only within the scope specified by the Company.


4. Account Management
. NRC verification is required for using our service.
. Users are responsible for managing their registered phone number, email address, password, and NRC/Passport 's information at their own responsibility. Users shall not disclose, lend, transfer, change the ownership, or engage in buying/selling the login ID and password to a third party for accessing the Application.
. If the service is used with the registered information, the usage will be treated as if the registered user themselves had used it. Therefore, any consequences and responsibilities arising from such usage shall be attributed to the registered user.
. If the Registered Information is found to be stolen or used by a third party, the user shall immediately notify the Company and follow the Company's instructions.
. In case of any damage caused to the Company or third parties due to the unauthorized use of information, the user shall compensate for such damages.


5. Backup
Users are responsible for taking backups and appropriately managing their data using their own backup, if needed.


6. Prohibited Actions
Users shall not engage in the following action(s) while using the service:
. Action that causes disadvantages or damages to other users, the Company, or third parties.
. Action that violates laws and regulations.
. Unauthorized access or use of other users' accounts.
. Distribution of harmful software or content.
. Violation of intellectual property rights related to the service held by the Company or third parties.
. Action that undermines or defame the credibility of the service.
. Duplicating, adapting, editing, modifying, reverse assembling, reverse compiling, or reverse engineering the service.
. Harassment, abuse, or offensive behavior towards others.
. Any action that disrupts or interferes with the service's functionality.
. Any other action that the Company deems inappropriate.


7. Service Period
This agreement shall be in effect from the time of the Application installation until the time of uninstalling the Application.


8. Termination by user
. User may cancel use of services by deactivating the account if they wish to suspend or terminate.


9. Support
User can obtain support from the Company through the designated phone number / email address via customer service. Support responses will be provided during the Company's business hours, and if a response cannot be given within those hours, it will be provided on the following business day..


10. Liability and Disclaimer
. We, the Company, undertake to develop, produce, and manage the service with utmost care and sincerity to ensure the stable provision of the service. However, we shall not be held responsible for any damages resulting from changes, interruptions, or terminations of the Service.
. We shall not assume any responsibility for the actions taken by users during their use of the service, their outcomes, or any damages incurred as a result of such actions.
. Users are responsible for all communication charges and fees incurred while using the service, and we shall not bear any of these expenses.
. We do not guarantee that the service is suitable for specific purposes, possesses expected functionalities, product values, accuracy, usefulness, complies with applicable laws or industry regulations concerning user usage, or that it will be free from malfunctions.
. We do not guarantee the delivery of goods or the payment of fees regarding individual transactions. Hence, we shall not be held responsible for any lack of product delivery or fee payment in individual transactions.
. We are not obligated to rectify any bugs or issues related to the Service, nor are we required to improve or enhance the Service. However, at our discretion, we may provide service with updates or version-up information for the Software. Users who use the Service as an application must promptly update the Application. In this case, the updated version or version-up information shall be treated as part of the Service, and these will also be subject to these Terms of use.
.Users shall acknowledge that changes in the terms of Service and operation policies of service stores, such as AppStore and Google Play, may limit or restrict the use of all or part of the service. . We shall not be liable for any damages directly or indirectly caused to users through the use of the service.
. We shall not be liable for any opportunity loss, business interruption, or any other damages (including indirect damages and lost profits) incurred by users or other third parties, regardless of whether we were notified in advance of the possibility of such damages.
. Data registered or created on the Service will be stored on servers operated by us or contractors entrusted by us. Although we will manage the storage of such data with due diligence, unforeseeable events such as equipment failure, troubles, power outages, abnormal communication lines, or system failures beyond our control may cause data loss or other issues related to user information and other data. In such cases, we shall not be held responsible for any damages resulting from data loss.
. We shall not be liable for any damages or other disadvantages caused by user errors or unauthorized use by third parties in connection with the use or operation of the service.
. We shall not be responsible for disputes and troubles between users and other users.


11. Server Maintenance
. Our company and the contracted business operators will conduct regular server and system maintenance to provide this service. We will strive to complete the maintenance as quickly as possible and consider the users' usage to avoid interference.
. In the event that extended maintenance becomes necessary, except in emergencies, we will make efforts to notify users in advance through our website or other means to minimize inconvenience. However, during such maintenance, our company shall not be held liable for any damage that occurs to users or third parties.


12. Notification and Communication
Our company will use the registered email address or other suitable methods to notify and communicate with the user regarding service-related matters.


13. Change, Suspension and Termination of the Service
Our company may change or temporarily suspend all or part of this service with (or) without prior notice to the user in the following cases:
. Force majeure events such as natural disasters, power outages, or wars, making service provision impossible.
. When the Company determines that it is necessary to temporarily suspend the operation of the Service.
. System maintenance by our company.
. Suspension or termination of the cloud service provided by the contracted service provider.


14. Intellectual Property Rights
All rights related to this service, including ownership, intellectual property rights (such as patents and copyrights), portrait rights, publicity rights, and other rights, belong to our company or the third parties owning these rights. Users are not granted any rights in connection with this service, and our company provides users with a non-exclusive and non-transferable license to use this service on their devices, subject to these Terms of Use.

Regarding all information posted, uploaded, or stored by users in this application, our company may store and accumulate such information and use it in any manner for the purpose of smooth operation, improvement, and promotion of this service including publication in third-party media as featured articles or content.
In the event of any violation of the provisions of this section, causing issues such as infringement of rights, users shall resolve such issues at their own expense and responsibility and shall not cause any trouble or damage to our company. In the event that our company incurs damages, users shall compensate our company for all such damages.


15. Confidentiality Protection
We don’t sell your personal data to advertisers, and we don’t share information that directly identifies you (such as your name, email address or other contact information) with advertisers unless you give us specific permission. Instead, advertisers can tell us things like the kind of audience they want to see their ads, and we show those ads to people who may be interested.

Personal information will be handled appropriately in accordance with the "Privacy Policy" set forth by our company. Please refer to our Privacy Policy to understand how we collect, use, and protect your personal information.


16. Transfer of Rights and Obligations
Users are prohibited from transferring or pledging to third parties the rights and obligations arising from this agreement under these Terms of Use.

In the case of our company transfers the business of this service to a third party (including substantial transfers through company division, etc.), our company may transfer, pledge, or dispose of the contractual status under this agreement and the rights and obligations arising from this agreement to the third party without the prior consent of the user, provided that the user has been notified in advance.


17. Termination by the Company
The Company reserves the right to terminate or suspend your access to the Application for any reason without prior notice. Our company shall not be held responsible for any damages incurred by the user due to actions taken by our company under this clause.


18. Dispute Resolution and Compensation
Users shall be liable to compensate our company for any damages caused to our company due to a violation of these Terms of Use or related to the use of this service.


19. Changes to the Terms
Our company reserves the right to revise the content of this agreement at any time without obtaining the user's consent, and the user agrees to accept such revisions without objection. When our company revises this agreement, we will notify the users of the content through our designated method. The revisions to this agreement shall take effect from the time when our company has notified.


20. Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of Cambodia. Any dispute arising out of or relating to these Terms or the use of the App shall be subject to the exclusive jurisdiction of the courts of Cambodia.
